This Agreement (“Agreement”) is a legal contract between Tracking System Direct (“The Company”) and you, including your heirs, agents, successors, and assigns (“You”). This Agreement becomes effective when you start using, purchase, or electronically agree to our products, and it outlines the rules and responsibilities related to using The Company’s products, software, and services (“Products”).

By acquiring Products from The Company, you are stating that you have read this Agreement, understand it, and agree to follow it. This includes any changes we might make in the future and any additional policies associated with the Products.

*USER AGREEMENT ON LIABILITY: By using our Products, you agree that if anything goes wrong, The Company’s responsibility is limited to either giving you a replacement or refunding you the cost of the Product.

**TECHNOLOGY LIMITATIONS: Please understand that GPS technology, which our Products rely on, has its limits and is influenced by factors beyond our control. It’s crucial to read and understand the instructions and limitations of the technology to ensure proper use.


Using the Products

The Company might change this Agreement and its Services occasionally. By continuing to use the Products, you are agreeing to accept these changes. This Agreement stays in effect as long as you use the Products. If you decide to stop using the Products, The Company will not give you a refund unless we’ve agreed to this in writing.

Notices and Warnings

By using the Products, you confirm that you have read and understood all the warnings and instructions that come with them. If you didn’t see these when you got the product, it’s your responsibility to look them up on the Tracking System Direct website and to share them with anyone else who might use the product. We are not responsible if you fail to read or follow these warnings or instructions.

Email Updates

Buying and using our live GPS tracking devices means we’ll send you email updates with tips, promotions, and other information about our services. You can choose not to receive these emails if you want, and you can also update your contact information by getting in touch with us at

Using Our Services

We aim to provide GPS related services all the time, but we cannot guarantee they will be uninterrupted or error-free. Various factors, including equipment problems, maintenance, or other issues beyond our control, might cause breaks in service. We will not provide refunds or credits for these interruptions.

Proper and Lawful Use

You agree to use our Products in a lawful and appropriate manner, following all relevant laws. The Company has the right to share your information and tracking records with law enforcement agencies if they provide the necessary legal documentation. Any illegal or improper use of our Services could lead to termination without a refund.

Termination for Legal Reasons

If your use of our Services leads to legal action against The Company, we have the right to terminate your Services. The customer is solely responsible for getting the necessary permissions for tracking and agrees to protect The Company from any claims related to unauthorized tracking. We recommend talking to a lawyer if you’re unsure about the laws relating to tracking devices, as they can vary significantly depending on where you are.

Lithium-Ion Battery Safety

When using products with lithium-ion batteries, please ensure you understand and follow all safety guidelines provided. Mishandling these batteries can pose a fire risk, and you are responsible for their proper care and ensuring all products are in good working condition.

Product and Software Integrity

You agree to keep all equipment and software from Tracking System Direct intact, including not tampering with the SIM card in tracking devices. That also includes using any other equipment not authorized by The Company to change batteries, gaskets, etc. We will bill you for any charges that result from modifying the SIM card or using it in a device not registered on our website.

Secure Your Account

Maintain the confidentiality of your login details and notify us immediately if you suspect any unauthorized use of your account. We are not liable for losses incurred due to unauthorized account use. You could be held responsible for losses incurred by Tracking System Direct or others due to such unauthorized use.

Provide Accurate Information

While using our services, you agree to provide accurate information and to inform us of any changes within five business days. Failure to do so constitutes a breach of our agreement. We reserve the right to terminate our services and close your account if we find your information to be false or misleading. We may also investigate your account and use various data to respond to legal inquiries or defend against chargebacks.

Payments and Fees

You agree to pay Tracking System Direct for any software or services ordered, including GPS tracking equipment, at the time of order. All fees are due immediately upon device activation and are non-refundable. We may change pricing at any time with notice. Payments can be made with a valid credit or debit card. Your billing cycle begins on the delivery date of the device and runs in advance. You may opt for monthly or annual billing. Cancellations must be requested in writing at least 10 days before the end of the billing cycle to avoid additional charges. Cancellation requests after billing but before the service start date will incur a $10 service fee.

Subscription Termination

You may cancel your subscription at any time through the provided cancellation link. Monthly subscriptions remain active until the end of the current billing cycle.

GPS Tracking Data

GPS tracking data is stored for one year and requires an active account to access. Upon service termination, all GPS data will be erased and cannot be restored.


Sections on disputes, arbitration, jurisdiction, venue, disclaimer of warranties, limitation of liability, and indemnification will remain in effect even after this Agreement ends.

Dispute Resolution and Legal Venue

If any disagreements arise between you and Tracking System Direct, we encourage direct negotiation. If that fails, we may choose to mediate via the American Arbitration Association (AAA), following their Commercial Mediation Rules. Any unresolved disputes will proceed to binding arbitration under AAA’s then-current rules in Gulfport, Mississippi. If a legal remedy is necessary outside arbitration, both parties agree to use a Riverside County, California court.

Warranty Disclaimer

Tracking System Direct does not guarantee the accuracy, legality, or availability of information accessed using our product or software, disclaiming all responsibility for any inaccuracies or omissions. Any damage from downloading or accessing data is solely at your risk.

Limitation of Liability

The reliability of GPS Technology depends on various independent factors, and Tracking System Direct cannot guarantee uninterrupted or error-free operation. Any damages resulting from the use or inability to use the product, including lost profits or data, are not our responsibility.


You agree to protect Tracking System Direct against any claims, damages, or expenses arising from your breach of this Agreement, negligence, or misuse of our product.

Software Security

Using our product may expose your computer to open networks, posing potential security risks. You use such networks at your own risk, and we encourage you to take protective measures, like installing antivirus software. By using our product, you accept these risks and agree to our Terms and Conditions and Privacy Policies.

No Warranties

All materials and services are provided “as is” unless explicitly stated otherwise in writing. Tracking System Direct and its partners disclaim all warranties, expressed or implied, to the fullest extent permitted by law.

Terms Of Service

Tracking System Direct and its online store assume no liability associated with the usage of any products purchased.

  • If the product(s) or service(s) are ordered and are found to be out of stock for any reason, a refund or credit will be issued if funds were acquired.
  • Prices can be subject to change.
  • The purchaser signifies agreement to all Terms of Sale and conditions when completing and submitting an order.
  • The purchaser holds complete liability and responsibility for any damages, losses, or any type of expenses associated with the misuse or use of any products purchased on the Tracking System Direct website.

Activation and Monthly Data Plan for GPS Devices

  • Activation Prior to Shipment: Tracking System Direct (“the Company”) will only ship out GPS devices that are active. Activation is a mandatory step prior to the dispatch of any GPS product from our facility.
  • Customer Authorization for Activation: The Company requires explicit authorization from the customer to activate the GPS unit. Such authorization must be provided through a phone call to our customer service. Please note that the mere placement of an order for the tracker does not automatically entail or authorize the billing of the associated data plan.
  • Billing of Data Plans: All monthly data plans associated with our real-time GPS devices are billed on the first of every month. The customer is responsible for ensuring timely payment to maintain uninterrupted service.
  • No Service Contracts: Our data plans operate on a month-to-month basis. Customers are not bound by any long-term service contracts. The flexibility of this system allows customers to avail of our services based on their current needs without any extended commitment.

Cancellation of Service:

  • Customers wishing to cancel their data plan service must provide the Company with a written notice of such intention via email. The notice must be submitted at least 30 days prior to the desired cancellation date.
  • Upon receipt of the cancellation request, the Company will send a confirmation email to the customer, acknowledging the receipt of the notice and the processing of the cancellation.
  • If a customer does not receive a confirmation email within 48 hours of sending the cancellation notice, they are advised to call our customer service for assistance. Failure to do so may result in continued billing until the cancellation process is complete.

Confirmation of Cancellation: It is the customer’s responsibility to ensure they receive a confirmation of their cancellation request. If the confirmation is not received, the onus is on the customer to inform the Company and ensure the request is processed appropriately.

By purchasing a GPS device and associated data plan from Tracking System Direct, customers acknowledge they have read, understood, and agree to adhere to the above terms and conditions.

Legal Status & Liability

The purchaser of the product has the sole responsibility to confirm and comply with any and all applicable federal, state, and/or local laws regarding the use of GPS tracking devices. It is essential for the purchaser to be aware that GPS tracking laws may vary from state to state, and it is their obligation to educate themselves on the specific laws applicable to their jurisdiction before purchasing any product from Tracking System Direct. We strongly recommend that purchasers consult with an attorney to ensure full compliance with all relevant laws prior to making a purchase.

Under no circumstances shall Tracking System Direct ( be held liable for any indirect, direct, special, consequential, or incidental damages arising from the inability to use, misuse, or use the product(s) or service(s) that are purchased from Tracking System Direct or The purchaser acknowledges and agrees that they assume all risks and responsibilities associated with the use of the products or services provided by Tracking System Direct.

By submitting an order, the purchaser represents and warrants that they will use the product acquired from Tracking System Direct in a responsible, lawful, and ethical manner. The purchaser further affirms that they will not engage in any activities that violate applicable laws or infringe upon the rights of individuals. Tracking System Direct disclaims any liability for the misuse or illegal use of its products and emphasizes that it does not condone or endorse any activities that are illegal or unethical.

It is essential for customers to understand that Tracking System Direct is a provider of GPS tracking devices and related services. While we strive to offer reliable and accurate products, it is ultimately the purchaser’s responsibility to ensure their compliance with the law and the ethical use of the products. Tracking System Direct explicitly disclaims any liability for the actions or behaviors of its customers and the use of its products outside the bounds of applicable laws.

Credit Card Disputes

If a dispute is filed for any transaction, the cardholder or purchaser who submitted the order will be held liable for, but not be restricted or limited to any and all associated fees, and civil, legal, and administrative costs required to resolve the dispute. Collections will be sought by alternative means if an order placed via credit card is disputed and then overturned by the issuing creditor. Any and all such additional costs will be added to the settlement amount and will be the responsibility of the individual who submitted the order (purchaser), or the cardholder to pay. Any form of legal action may result in a judgment that may negatively affect the cardholder’s credit score and/or rating.
